Loss of dependency calculations

There is debate on the correct calculation of losses and the calculation of claims in fatal accidents can be a complex exercise with a range of potential pitfalls.

As expert accountants with experience of such cases, our forensic services team has prepared a CPD accredited course. The course is designed to guide lawyers through this often challenging subject, providing a practical approach to the more difficult aspects flowing from the relevant case law on loss of dependency.

The topics covered include:

  • earnings of the deceased and the dependant
  • a guide to factors to be taken into account in quantifying the earnings of the deceased but for death
  • a guide to the treatment of the earnings of the dependants to be applied in a dependency calculation
  • an outline of the relevant case law and the practical implications of its application

Dependency factors

  • a guide to the calculation of appropriate dependency factors
  • circumstances that may lead to varying the ‘rule of thumb' dependency factors
  • an outline of the relevant case law and the practical implications of adopting different methodologies relating to dependency factors

Multipliers

  • an outline of the relevant case law
  • explanations and comparisons between the ‘Traditional' and Law Commission methodologies to calculate multipliers

Other issues

  • potential double recovery under Section 4 of the Fatal Accidents Act and the relevant case law
  • changing future annual loss of dependency
  • pension loss in dependency calculations
  • analysis of family expenditure

Case study

  • worked examples highlighting the effect on quantum of adopting alternative approaches to the dependant's earnings, dependency factors, multipliers

Course details:

  • duration approximately 1½ hours, including questions
  • CPD accredited with the Law Society and ILEX
  • free of charge, including extensive course notes and, if necessary, presentation equipment
  • can be presented at your offices at a time convenient to you and to groups of six or more
